Welcome to Found! These Terms and Conditions (“Terms”) govern your use of the Found app and services. By accessing or using Found, you agree to these Terms. If you do not agree, please do not use the app.

1. Acceptance of Terms

By creating an account or using Found, you confirm that:

• You are at least 18 years old.
• You have the legal authority to enter into this agreement.
• You agree to abide by these Terms.

2. Account Registration

• Accuracy of Information: You agree to provide accurate and truthful information during registration and maintain its accuracy throughout your use of the app.
• Security: You are responsible for maintaining the confidentiality of your login credentials and are solely responsible for all activities under your account.
• Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

3. User Conduct

You agree to use Found in a lawful and respectful manner. Prohibited activities include but are not limited to:

• Misrepresenting your identity, age, or other personal details.
• Harassing, threatening, or otherwise harming other users.
• Uploading offensive, explicit, or illegal content.
• Spamming, phishing, or attempting to scam other users.
• Using the app for any commercial or non-personal purpose without permission.

Found reserves the right to monitor and review activity on the platform and take action, including terminating accounts, as deemed necessary.

4. Subscription and Payment Terms

• Free Trial: Found may offer a free trial to allow users to explore the app before subscribing.
• Subscription Plans: Paid subscription plans, including the annual subscription, grant access to premium features. All payments are non-refundable except where required by law.
• Payment Processors: Payments are processed securely through third-party providers like Stripe and PayPal. Found does not store your payment information.
• Renewals: Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current billing cycle.

5. Privacy

Your use of Found is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using Found, you consent to our Privacy Policy.

6. Intellectual Property

• Ownership: Found retains all rights, titles, and interests in the app, including but not limited to software, branding, and content.
• User Content: By uploading content (e.g., photos, bios), you grant Found a non-exclusive, worldwide, royalty-free license to use, modify, and display your content for the purpose of providing the service.
• Restrictions: You may not copy, modify, distribute, or reverse-engineer any part of the app without prior written permission from Found.

7. Disclaimer of Warranties

Found is provided on an “as is” and “as available” basis. We make no warranties or representations regarding:

• The accuracy or reliability of user profiles or matches.
• The uninterrupted or error-free operation of the app.
• The success of finding a compatible match.

To the fullest extent permitted by law, Found disclaims all warranties, express or implied.

8. Limitation of Liability

To the maximum extent permitted by law:

• Found and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.
• Our total liability for claims related to the app shall not exceed the amount paid by you for the subscription in the last 12 months.

9. Indemnification

You agree to indemnify and hold harmless Found, its affiliates, employees, and agents from any claims, damages, or expenses arising out of your use of the app, violation of these Terms, or infringement of third-party rights.

10. Termination

• Found reserves the right to suspend or terminate your account for violations of these Terms or for any other reason at its sole discretion.
• You may terminate your account at any time by contacting customer support or using the in-app account deletion feature.
• Upon termination, your right to use the app will cease immediately, but Found may retain certain information as required by law or as outlined in our Privacy Policy.

11. Changes to the Terms

Found may update these Terms from time to time. Material changes will be communicated to you via email or app notifications. Continued use of the app after changes indicates your acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

• These Terms are governed by the laws of Germany and Austria, without regard to its conflict of law principles.
• Any disputes arising from these Terms will be resolved through binding arbitration or in the courts of Germany or Austria, depending on your residence place.
